Equality between people and recognition of their innate rights and freedoms is a decisive tenet of theory creation and functioning of a democratic society. All people from their birth are free and equal in views, law, and religion. The ideas of free thought, freedom of choice and parity are axial constitutional categories of the individual. However, the ideas of equality of people opposed to the one of discrimination, which may take the form of many segregation shades including xenophobia and racism. Therefore, understanding of cause-effect relationships in the pathogenesis of racial, sexual or religious discrimination is a determinative step to the stage of the eradication of these ideas in the context of social development.
Universal Declaration of Human Rights approved by the General Assembly of the United Nations is the most authoritative source of international norms on human rights (“Federal Laws Prohibiting Job Discrimination Questions and Answers,” n.d.). According to it, phenomenon of discrimination is incompatible with a current stage of global society development. However, examples of direct or indirect discrimination can be traced until now.
Langwith (2008) stated that the cause of racial discrimination as any other one lies in a different kind of prejudice and fear. Historically, racial discrimination could be the reason for segmentation of society, the social benefits distribution, as well as the revaluation of social norms. Biologically there are no objective reasons for justification of racial discrimination. However, due to ideological biases, certain race can position themselves above the rest. This results in local racial tensions and internal stresses within the society. If racial discrimination is supported by political ideology, it may be the cause of genocide. For example, the Holocaust made by the Third Reich is known to the world. From another point of view, because of social division within the modification of racial segregation, economic relations and the formation of the slavery phenomenon occur. These facts are unacceptable in the 21st century (“Equal Employment Opportunity,” n.d.).
The cause of sexual discrimination lies in preventing people from forming matrimonial and family law. To some extent sexual discrimination of gays can be justified by their opposition to the natural process of procreation. Such discrimination is based on the contrast to instinct conceiving a child. But the current stage of the international community should include a mandatory concept of pluralism in all phenomena and processes taking place in society. Dogma of the family, which forms moral and social values, to some extent, excludes the possibility of other family system. Such point of view contributes to social oppression towards sexual minorities, their association with pedophilia, increase internal charges toward gays and the spread of AIDS. This situation generates momentary protests testing a democratic society for durability.
Prevalence of different religions caused such phenomenon in terms of historical and cultural development of the nation. Religious discrimination is historically based on a desire to extend its sphere of influence through its aspects. As a result the Crusades, Teutonic Knights and others were formed. Today, religious discrimination is not global, but it may be the cause of local military conflicts. This situation is observed in the states of Africa and based on the conflict of Christianity and local religions. The presence of religious discrimination was one of the reasons provoking the emergence of numerous religious sects and trends, which in some cases have illegal character and interpret scripture for other purposes. Therefore, religious discrimination may not only cause military conflicts, but personal and spiritual wanderings in search of relevant truths.
Thus, regulation of discrimination is ensured through an integrated approach both on law and purely human levels. The phenomenon of difference, exclusion, restriction or preference which denies or reduces the equal enjoyment of the rights of people is caused only by their own prejudices, fear, lack of erudition and unreasoned interpretation. Consideration of religious issues as well as sexual and racial segregation helps to focus on the causes of these phenomena, and evaluate their consequences form in order to set preventive measures.
